Litigation Practice


The PFS Litigation Practice Group offers commercial litigation representation on the trial and appellate levels in both state and federal courts as well as in arbitration and mediation proceedings, throughout the United States.

The Litigation Practice Group, working in close association with our other practice groups, has the resources and experience to pursue and promote our clients' interests aggressively in a broad range of complex business, commercial, employment and securities litigation matters, as well as class action and multi-district litigation. Our attorneys have significant experience representing clients in matters such as: contract disputes; commercial torts; shareholder disputes and minority shareholder rights cases; director, officer and employee fraud and breach of fiduciary duty claims; claims regarding theft of proprietary business information and unfair trade practices; securities litigation (including SEC investigations, 10-b5 claims and shareholder derivative actions); lawsuits concerning discrimination, harassment, retaliation and termination of employment, covenants not-to-compete and other employment-related matters; lawsuits concerning mergers and acquisitions; lawsuits concerning real estate acquisition, disposition, lease and construction matters; insurance coverage disputes; injunction proceedings; and day-to-day handling of pleadings, discovery, pre-trial, trial, and appeal of commercial disputes.

A fundamental precept upon which we base our practice in business disputes is to work closely with our clients to gain an early understanding of the value and significance of the controversy and devise an effective case management strategy. We then propose the most economical approach for handling the matter and execute the approach efficiently. This methodology allows us to undertake the matter within our clients' expectations.

In the expensive, risky, and often uncontrolled world of litigation, we know that the optimal litigation strategy for addressing one problem may be wholly unsuitable for another. The litigators at PFS have come to learn that early, hands-on, client-involved management of business disputes is the only way to achieve economical results in business litigation. Perhaps more importantly, by appropriately staffing litigation matters, these efficiencies are achieved without sacrificing the superior work product clients expect and deserve.
